If our work life was as blissful and trouble free as Confucius’ quote aspires it to be, there would be no need for employment laws and the lawyers who practice them. Unfortunately, the relationship between employer and employee has historically been one fraught with employers subjecting employees to overbearing control, oppressive treatment, unsafe work conditions, bias fueled unfairness and grievous retaliation. It’s no wonder this relationship was once referred to as one of master (employer) and servant (employee). And this would remain an apt description today if not for the enactment of federal and state laws and rules regulating the relationship between employers and employees.

Employment laws seek to ensure that employment decisions are based on the merit of a person’s qualifications or track record of performance as opposed to opinions and beliefs based on negative stereotypes associated with classes of people with common characteristics and backgrounds. Because of this we now have laws that prohibit employers from discriminating against any employee or job applicant because of race, color, religion, national origin, sex, age, marital status, pregnancy, physical or mental disability, and/or sexual orientation . This is also why we have laws protecting employees who blow the whistle on employers who violate the law or operate contrary to federal or state public policy. Employment laws also serve to regulate the more granular aspects of work life such as dictating the minimum pay employees must receive, mandating the work environment be safe and hazard free, and permitting workers leave from work to care for their own serious medical conditions and those of their immediate family members.
